A former employee has filed a lawsuit against Riverside Health, headquartered in Newport News, VA, claiming the hospital system did not pay her and other employees for all the hours they worked [4]. Filed in federal court on May 7, the former employee claims Riverside automatically deducted 30 minutes from workers' pay each day for meal breaks, even when those breaks were missed or interrupted by work duties [4]. The lawsuit also claims that Riverside rounded employees' clock-in and clock-out times to the nearest quarter hour "for its own primary benefit" [4]. The worker claims that Riverside's policies violate the Virginia Overtime Wage Act, Fair Labor Standards Act, and Virginia Wage Payment Act [4]. The employee, who worked as a respiratory therapist from November 2021 through April 2024, brought the class and collective action lawsuit forward on behalf of herself and other hourly Riverside employees [4]. The complaint is requesting back pay, liquidated damages, and other legal remedies for the employee and other employees [4]. Riverside released a statement saying they are aware of the lawsuit and are reviewing the matter thoroughly [4]. The worker also claims that Riverside pays employees nondiscretionary bonuses, including sign-on bonuses, that it fails to include in their regular rates of pay, therefore reducing overtime rates of pay [4].
