Boston Children's Hospital filed a lawsuit on June 17, 2025, against 33 Blue Cross Blue Shield entities across the United States. The hospital alleges that these geographically restricted insurers have engaged in a conspiracy to establish a payment system that violates anti-trust laws. This system, according to Boston Children's, forces the hospital and its affiliated doctors to accept lower reimbursement rates compared to those from other national insurers like United, Cigna, and Aetna. The hospital claims that almost half of its revenue comes from patients outside of Massachusetts covered by various Blue Cross plans, but it can only submit claims to Blue Cross Blue Shield of Massachusetts (BCBS-MA), which dictates the payment rates. The lawsuit argues that if Boston Children's were to refuse BCBS-MA's rates, other Blue plans would cease doing business with them, giving BCBS-MA significant leverage within Massachusetts due to its large market share. Boston Children's contends that the Blue Cross Blue Shield entities' market allocation scheme and other anticompetitive practices result in the hospital being reimbursed at rates that are at least 15-20 percent or more below those of other major national insurers. If successful, this lawsuit, filed in US District Court in Boston, could potentially lead to a significant restructuring of the Blue Cross Blue Shield system by forcing individual plans to compete across state lines.
