A whistleblower lawsuit alleging that Erlanger Health System routinely billed for concurrent surgeries where residents completed procedures without proper supervision has been settled [6, 8]. The lawsuit was filed in April 2021 by former chief information officer Stephen Adams, MD, and orthopedic surgeons Julie Adams, MD, and Scott Steinmann, MD, under the federal False Claims Act and Tennessee Medicaid False Claims Act [6]. The complaint centered on allegations that hospital staff illegally billed for two or three surgeries performed simultaneously without proper oversight by a supervising physician [6]. On April 15, a district judge dismissed the case after the parties reached an undisclosed settlement [6]. Erlanger had disputed the claims and stated there was no evidence teaching physicians were not present during critical surgery portions [6].

Erlanger and UnitedHealthcare (United) have reached a new agreement that allows patients with United commercial plans to maintain in-network access to Erlanger hospitals and providers [10]. Because the agreement was reached before the previous contract expired, patient care can continue without interruption [10].
