Erlanger Medical Center and Erlanger Health System, along with three whistleblowers, have reached a settlement to resolve a False Claims Act lawsuit. The lawsuit alleged Medicare fraud. The parties submitted a notice of filing a proposed order dismissing the case to the U.S. District Court for the Eastern District of Tennessee on Sunday. A stipulation of dismissal was filed by the parties on April 9, and the U.S. government consented to the dismissal on April 10. The terms of the settlement have not been disclosed. The underlying lawsuit, which the government intervened in, alleged that Erlanger violated the Stark Law by maintaining improper financial relationships with several physicians between 2014 and 2021. These alleged violations involved compensating physicians at rates significantly above fair market value to incentivize referrals, resulting in the submission of false claims to Medicare. The government contended that Erlanger compromised Stark Law compliance to boost its financial standing and knowingly overpaid physicians whose practices generated profits for the hospital. The lawsuit was initially filed by former Erlanger executives under the False Claims Act's whistleblower provisions.
