United Surgical Partners International is facing a proposed class action lawsuit in federal court alleging violations of the Illinois Biometric Information Privacy Act. The lawsuit claims the company illegally collected employees' fingerprint scans. Despite a recent change in Illinois law that limits damages under the act, the plaintiffs were able to proceed in federal court because the amendments were enacted after their lawsuit was filed and do not apply retroactively to existing cases. Judge Sunil R. Harjani of the U.S. District Court for the Northern District of Illinois ruled on Thursday, May 29, 2025, that the plaintiffs met the amount-in-controversy requirement for federal diversity jurisdiction, allowing the case to move forward.
