The investigation focuses on the compromise of sensitive personal identifiable information and protected health information, which included health insurance information such as primary, secondary, or other health plans/policies, insurance companies, member/group identification numbers, and government-Medicaid-Medicare payer identification numbers. This investigation stems from a security incident where an unauthorized third party may have compromised sensitive personal information of patients who visited the hospital between August 2022 and September 2023. Auxilio Mutuo Hospital had posted a notice of the incident on its website and is offering affected individuals credit monitoring services. The law firm is investigating on behalf of those affected by the breach.

Hospital Español Auxilio Mutuo, underscores the exclusive authority of the National Labor Relations Board (NLRB) for such claims, even when plaintiffs file under local statutes like Puerto Rico's Law 115 (Retaliation) and Law 80 (Wrongful Discharge). The court emphasized that the focus for preemption analysis is the nature of the alleged conduct, not the law invoked, noting that the employees had already filed charges with the NLRB based on the same allegations of being terminated for participating as witnesses in a union-backed complaint to the Puerto Rico Department of Health, which is conduct covered by Section 8 of the NLRA. [12] The breach, which was initially announced as a security incident, was later confirmed by a second investigation to have resulted in the exfiltration of data belonging to nearly 1.2 million patients between August 2022 and September 2023. [12] According to the article, the hospital stated it has since taken steps to strengthen its network systems to reduce the risk of similar incidents and offered affected individuals credit monitoring and identity theft protection. Hospital Español Auxilio Mutuo de Puerto Rico confirmed a data breach incident that was initially detected following a notification from the Department of Homeland Security on September 23, 2023, indicating a likely targeting by a cybercriminal group. An investigation was launched, which in November 2023 found evidence consistent with unauthorized network access. Further investigation identified evidence consistent with data exfiltration from systems containing patient data on May 15, 2024. By September 24, 2024, a team of internal and external IT experts concluded that the breach was limited to patients who received services at the hospital between August 2022 and September 2023. While the exact information compromised for each individual could not be determined, potentially stolen data included names and possibly medical records, diagnostic information, and other patient care-related data. The hospital has stated that it has no evidence yet that the information has been misused. They are offering complimentary credit monitoring and identity theft protection services to affected individuals and have reported the breach to the HHS' Office for Civil Rights.
