The state of New Hampshire, the New Hampshire Hospital Association, Dartmouth Health, and Concord Hospital Health System have reached a settlement agreement concerning the ongoing litigation over the state's Medicaid Enhancement Tax and Disproportionate Share Hospital payments. This settlement, announced on May 23rd, resolves a lawsuit filed in April challenging the tax. Hospitals pay this tax on net patient services revenue and receive a portion back through Disproportionate Share Hospital payments. The dispute arose partly from a plan initiated in 2024 to redirect some of these tax dollars to community mental health and federally qualified health centers, which hospitals argued would result in significant losses. Governor Kelly Ayotte stated that the agreement is beneficial for the state, rural healthcare access, and patients, thanking the involved parties for reaching a resolution. Dartmouth Health, the New Hampshire Hospital Association, and Concord Hospital and Concord Hospital-Laconia filed a lawsuit against the state of New Hampshire, challenging the constitutionality of the Medicaid Enhancement Tax (MET). This action was taken after months of unsuccessful negotiations with the state regarding the financial impact of proposed changes to the MET on hospitals. The MET is a tax on hospital revenues that is matched by federal funds to support Medicaid, but the hospitals argued that the state's planned adjustments would lead to a significant loss of revenue for them. Despite previous court rulings deeming the MET unconstitutional, hospitals had continued to pay the tax under prior settlement agreements, which have now expired. Dartmouth Health, in particular, stated that under the current tax agreement, it would bear a disproportionate share of the lost revenue due to its location near the Vermont border and the inclusion of out-of-state patient revenue in the MET calculation without corresponding supplemental payments from the state. The lawsuit aims to protect access to healthcare services for patients across the state.
